To the maximum extent permitted by law, Engagelyt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits or revenue, loss of data or business opportunities, service interruptions, or communication failures (email or call delivery). Our total liability arising from or related to the Service shall not exceed the fees paid by you for the Service during the three (3) months preceding the event giving rise to the claim.

4. Email and communication disclaimer

We do not guarantee email delivery, open rates, click-through rates, or response outcomes. Email performance depends on multiple factors beyond our control, including recipient systems, spam filters, and network providers. You are responsible for ensuring lawful and compliant use of email and communication features.

5. Call and telephony disclaimer

Call quality, routing, recording, and availability depend on third-party carriers and network conditions. We are not responsible for call failures, dropped calls, or carrier outages. You are responsible for complying with all applicable call recording and telecommunication laws.

Where required by law, you must notify call participants that calls may be recorded. Default IVR notices may be used to inform callers for quality and training purposes.

6. No reliance on results or analytics

Reports, analytics, and performance metrics provided by the Service are informational only. We do not guarantee business outcomes, lead conversions, customer engagement, or sales results based on use of the Service.

The Service may include links or integrations with third-party websites or services. We do not control and are not responsible for third-party content, privacy practices, availability, or accuracy of third-party services. Use of third-party services is at your own risk and subject to their terms.

Power failures, ISP outages, regional infrastructure disruptions, or other utility interruptions may affect system availability. Such disruptions are outside our control and are not covered by Engagelyt.
